In December, the Conservative Business Journal speculated that the end of Roe v Wade was on the horizon as the Supreme Court heard Dobbs v. Jackson Women’s Health. This speculation has proven to be well-founded. Groundbreaking leaked court documents confirm that the conservative majority on the Supreme Court has voted to overrule Roe v Wade.

Conservative Supreme Court Justices Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett sided with Justice Samuel Alito in his majority opinion, which eviscerated the judicial reasoning in Roe v. Wade and previous cases. Politico accurately described Alito’s majority opinion the following way:

“A full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional projections of abortion rights.”

Alito’s majority opinion is certainly unflinching. Throughout the 98-page draft decision, Alito tactfully dismantles abortion advocates’ belief in a constitutional right to abortion. He made the convictions of the conservative members of the Supreme Court clear by saying:

“Roe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences. And far from bringing about a national settlement of the abortion issue, Roe and Casey have enflamed debate and deepened division. It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives…This is what the Constitution and the rule of law demand.”

On page 24 of the draft decision, Alito goes on to condemn the foundational arguments that prop up Roe v Wade:

“The inescapable conclusion is that a right to abortion is not deeply rooted in the Nation’s history and traditions. On the contrary, an unbroken tradition of prohibiting abortion on pain of criminal punishment persisted from the earliest days of the common law until 1973.”

With such bold statements from Alito’s majority opinion, it is all but certain that the Supreme Court will overrule Roe v Wade. However, leftists are doing everything in their power to disrupt the Court’s process.

Alito’s draft majority opinion comes to us via documents leaked to Politico. The only people with access to Supreme Court justices’ draft opinions are the justices and their law clerks. Prominent conservative thinkers believe that a leftist activist from within Justice Sonia Sotomayor’s office leaked the confidential court documents.

This is the first time a Supreme Court draft decision has ever been leaked to the public, and it is clearly intended to upset the entire judicial process. Releasing Alito’s draft to the public puts immense public pressure on the conservative justices to not sign on to the opinion.

You may notice that one conservative justice failed to side with the majority opinion, Chief Justice Roberts. Roberts has long been a RINO (Republican in Name Only). To his credit, Roberts has ordered an investigation into what he calls an “egregious” leak of the draft abortion opinion.
